The Commission has received a complaint from Shri Yoginder Kumar of
Uttam Nagar, New Delhi that his request dated 11.07.2008 under RTI Act, 2005
submitted to Central Public Information Officer, AVD-II, Department of Personnel
& Training, New Delhi and another application dated 18.07.2008 u/s 5(2) of the
Act that had been further transferred to the CPIO, AVD-II Desk, DoP&T, North
Block, seeking information regarding suspension and re-instatement if
suspension was revoked of some CBI officials who were prosecuted in criminal
cases by CBI, together with copies of orders including note sheets regarding the
same, have not been responded to, even though the same were duly submitted
along with the requisite fee.
The Commission has decided to admit Shri Yoginder’s complaint u/s 18(1)
(b) of the Act and hereby directs the CPIO, AVD-II Desk, Department of
Personnel & Training, North Block, New Delhi respond to both requests for
information within 15 working days from the date of receipt of this decision to the
Complainant.
The CPIO, AVD-II Desk, Department of Personnel & Training, North
Block, New Delhi is further directed to show cause as to why a penalty of Rs.
250/- per day from the date when the information fell due i.e. 11.08.2008 and
28.8.’08 to the date when the information is actually supplied in each case, not
exceeding Rs. 25,000/- should not be imposed on him/ her in both cases under

Section 20(1) of the RTI Act. The CPIO may submit his/her written submission to
this Commission on or before 19.03.2010.
Announced this fifth day of March, 2010. Notice of this decision be given
free of cost to the parties.

application and payment of the charge prescribed under the Act to the CPIO of
