                                  JUDGMENT

A team of officers of the Electricity Board conducted an

inspection in the premise of the petitioner and prepared Ext.P1

site mahazar wherein it has been stated that the petitioner is

using her domestic electricity connection for the purpose of

conducting a tea shop and therefore, the tariff for supply has to

be changed. Pursuant thereto, Ext.P2 penal bill has been issued

to the petitioner. The petitioner filed Ext. P4 objection against

the same. The petitioner now seeks a direction to the 3rd

respondent to consider Ext.P4 and pass appropriate orders

thereof.

2. The learned sanding counsel for the Board submits

W.P.(C) No. 1253/2008/Y -2-

that Ext.P4 can be considered and orders passed in accordance

with law. Accordingly, I dispose of this writ petition with a

direction to the 3rd respondent to consider and pass appropriate

orders on Ext.P4 as expeditiously as possible. Till disposal of

Ext.P4, further coercive proceedings for recovery of the amounts

on Ext.P2 shall be kept in abeyance, if the petitioner pays 1/4th

of the amounts covered by Ext.P2.
