Heard Mr. Balram Singh learned counsel for the petitioner
and Sri B.L. Verma learned counsel for the opposite party
no. 3.
For the proposed order it is not necessary to issue notice to
opposite party nos. 4 and 5. However, since there are
disputes which are factual in nature and the District
Magistrate being the Chairman of the District Level
Committee is the best authority to look into the factual and
legal aspects of the petitioner’s case, the petitioner is given
the liberty to approach the District Magistrate with a fresh
representation annexing all the necessary documents.
If such a representation is filed along with the certified copy
of this order, the District Magistrate shall look into the matter
and pass a reasoned and speaking order in accordance with
law after giving opportunity of hearing to the petitioner as
well as the opposite party nos. 4 and 5 within a period of one
month.
With the above observation the writ petition is finally
disposed of.
