Heard the parties on the prayer for bail made on behalf of the
appellants.
It is submitted that the informant is not the eyewitness of the
occurrence; and that the appellants have remained in jail for about nine
years.
On the other hand, counsel for the State submitted that the
appellants are the sons of the elder brother of the husband of the informant
and as per the prosecution case the occurrence took place due to land
dispute; and that she was capable to recognize the appellant from a near
distance and that she told the name of the appellants to the persons, who
reached in the place of occurrence immediately; and that the Doctor’s
evidence corroborates the version of the informant.
In the circumstances, we are not inclined to grant bail to the
appellants. Accordingly, it is rejected.
