                                          JUDGMENT

H.L.DATTU, CJ,

Petitioner seeks disciplinary action against the first respondent. In

the writ petition several allegations are made by the petitioner not only against the

first respondent, but also the higher-ups in the police department. It is stated that

the higher-ups in the police department are trying to shelter the first respondent.

Therefore, a request is made in the writ petition to issue appropriate direction to

the respondents to initiate appropriate disciplinary proceedings against the first

respondent and complete those proceedings as expeditiously as possible.

2. When the matter was posted before the court for admission, we

had directed Sri.M.P.Sreekrishnan, the learned Government Pleader to get

appropriate instructions in the matter.

3. On instrucitions, Sri.M.P.Sreekrishnan, learned Government

Pleader, would submit that the respondents have already initiated appropriate

disciplinary proceedings against the first respondent by appointing an Inquiry

Officer to inquire into the allegations made against the first respondent. Further,

the learned Government Pleader would submit that the respondents will complete

the inquiry within four months from today.

4. Placing on record the statement made by Sri.M.P.Sreekrishnan,

learned Government Pleader, this writ petition is disposed of as under:

Order

i) The undertaking of Sri.M.P.Sreekrishnan, learned Government

Pleader, is placed on record.

ii) The Inquiry Officer shall complete the inquiry proceedings initiated

against the first respondent as expeditiously as possible, at any rate within four months

from today.

iii) If for any reason the disciplinary authority is not in a position to

complete the inquiry as undertaken by the learned Government Pleader, they are at

liberty to approach this court for extension of time on genuine grounds.

Ordered accordingly.
