Man disabled in road accident gets over Rs 23L compensation

accidentA 30-year-old man, who suffered permanent disability in a road accident involving a rashly driven scooter, has been awarded over Rs 23 lakh compensation by a Motor Accident Claims Tribunal (MACT) here. 

The tribunal directed National Insurance Company Limited, insurer of the offending scooter, to pay Rs 23,66,864 as compensation to victim DineshSingh, a resident of Karol Bagh here, who was riding pillion on a scooter when another scooter hit him due to which his right foot got crushed in 2010. 

“Respondent 1(driver), respondent 2 (owner) and respondent 3 being insurer of the offending vehicle are jointly and severally liable to make the payment of compensation to the petitioner (Dinesh),” MACT Presiding Officer S C Malik said.

While awarding the compensation, the tribunal relied on testimonies of the victim and eye witness Himanshu, who was riding the scooter while Dinesh was sitting behind him. 

According to the petition, filed by Dinesh, on March 14, 2010 he was going to a market with Himanshu on a scooter when another scooter came in a rash and negligent manner from the opposite side and hit them. 

Due to the impact, the scooter, on which Dinesh was riding pillion, fell down and his leg got crushed. 

Dinesh was rushed to Sir Ganga Ram Hospital where his right foot was amputated due to injuries sustained in the accident. 

Dinesh, who was earning a salary of Rs 16,000 per month, had claimed Rs 25 lakh as compensation for his sufferings. 

The driver and the owner of the scooter were proceeded ex-parte.
