         Shri Satyam Agrawal, Counsel for the petitioner.
         Shri Kamlesh Dwivedi, Counsel for the respondent No.2.

Petitioner has sought following relief :-

1. A writ, order or direction of appropriate nature
directing the respondents No.2 to declare the
result of the petitioner of supplementary
examination of MBBS Proff II (final year) with in
10 days in the interest of justice equity and good
conscious.

2. Any other relief deemed fit and proper in the
facts and circumstances of the case.

3. Costs be awarded to the petitioner.
Learned counsel appearing for respondent No.2 submitted
that the result of the petitioner for supplementary examination of
PROFF II MBBS course final year has been declared on
30.10.2011 in which petitioner’s examination has been cancelled
because of using unfair means by him. However, petitioner has
been allowed an opportunity to appear in the supplementary
examination.

In view of the aforesaid statement, learned counsel for the
petitioner seeks withdrawal of this petition with liberty to appear
in the supplementary examination.

Prayer is allowed.

This petition is dismissed as withdrawn with no order as to
costs.
